1. Who these terms are between
These terms form a legally binding agreement between you (the person or entity creating an account) and Aurenia Group Limited, a corporation incorporated under the Canada Business Corporations Act (corporation number 726662166), with registered office at 3 Old Lochview Court, Fall River, NS B2T 1J1, Canada ("tree·canopy", "we", "us", "our").
By creating an account or using tree·canopy, you confirm that you have read and agree to these terms. If you are creating an account on behalf of a business, you confirm you have authority to bind that business.
2. The service
tree·canopy is a voice-first arboricultural survey application. It lets you conduct BS 5837 and related tree surveys using voice capture in the field, stores your survey data, assists with species identification via AI suggestion, and generates draft PDF reports.
What the service is not: tree·canopy is a productivity tool. It does not replace the professional judgement of a qualified arborist. All AI suggestions — including species identification, field value extraction from voice, and report narrative — require your review and confirmation before use. You are the professional. You sign the report. We help you draft it.
We may update, add to, or remove features of the service from time to time. We will give you reasonable advance notice of changes that materially reduce functionality.
3. Accounts
You must create an account to use tree·canopy. You agree to:
- Provide accurate information when registering
- Keep your password confidential
- Notify us promptly at hello@treecanopy.app if you suspect unauthorised access to your account
- Not share your account with others (each person using tree·canopy must have their own seat)
You are responsible for all activity that occurs under your account.
4. Subscription plans and pricing
4.1 Available plans

Prices in other currencies (USD, EUR, AUD, NZD, CAD) are set via the relevant App Store storefront and may vary. Annual plans are approximately 17% cheaper than monthly (equivalent to approximately 2 months free).
4.2 Boost packs
Boost packs are one-time consumable purchases that add 100 voice parses or 10 reports to your account. They are available on Solo and Practice plans when you have reached your included allowance.
4.3 Price changes
We will give you at least 30 days' notice of any price change by email. If you are on an annual plan, the new price will apply at your next renewal date. You may cancel before renewal if you do not accept the new price.
5. Free trial
5.1 What's included
New accounts receive a 14-day free trial with no payment details required at sign-up. The trial includes:
- Up to 20 voice parses
- Up to 2 PDF report generations
- Full access to all other features
This is enough to complete one end-to-end BS 5837 survey.
5.2 After the trial
If you do not subscribe at the end of your trial, your account enters Read-Only Lite mode. In Read-Only Lite:
- All your surveys, trees, photos, and generated reports remain visible and exportable
- You cannot create new surveys, add trees, record voice, or generate new reports
- This state is free, indefinite, and does not require a credit card
Upgrade at any time to resume full access.
6. Read-Only Lite
Read-Only Lite applies to accounts that have reached trial expiry without subscribing, or to paid subscribers whose subscription has lapsed. It preserves your data and gives you access to export it without requiring payment. Creating or editing survey data requires an active subscription.
7. Billing and renewal
7.1 Monthly plans
Monthly plans renew automatically on the same date each month. You will be charged at the start of each billing period.
7.2 Annual plans
Annual plans renew automatically 12 months after purchase. We will send a renewal reminder by email at least 14 days before your renewal date.
7.3 Payment methods
Solo and Practice plans purchased through the iOS App Store or Google Play are billed by Apple or Google respectively under their standard payment terms. Enterprise plans are invoiced by Aurenia Group Limited via Stripe.
7.4 Cancellation
You may cancel your subscription at any time in your account settings (or, for App Store / Play Store subscriptions, through the relevant store's subscription management). Cancellation takes effect at the end of your current billing period — you retain full access until then. We do not offer prorated refunds for unused time on monthly plans.
7.5 Annual plan refunds
If you cancel an annual plan within 14 days of purchase or renewal, we will issue a prorated refund for unused complete months. Refund requests after 14 days are considered on a case-by-case basis.
7.6 Late payment
If a payment fails, we will retry for up to 7 days while notifying you by email. After 7 days of non-payment, your account moves to Read-Only Lite until payment is resolved.
8. Your data
8.1 Ownership
Your survey data — tree records, photos, reports, site polygons, voice transcripts, and any other data you create — is yours. We do not claim any ownership or licence over it beyond what is necessary to provide the service.
8.2 Export
You can export your data in CSV and JSON formats at any time from within the app. PDF reports you have generated are available for download while your subscription is active and in Read-Only Lite.
8.3 Deletion
If you delete your account, we will provide a 30-day window to export your data. After 30 days, your survey data is permanently deleted from live systems within 90 days and from backups within 180 days.
8.4 Processing
How we process your personal data is described in our Privacy policy. How we process data on your behalf is governed by our Data Processing Agreement.
9. Acceptable use
You agree not to use tree·canopy to:
- Violate any applicable law or regulation
- Infringe any third party's intellectual property rights
- Submit false, misleading, or fraudulent survey data
- Attempt to gain unauthorised access to the service or its infrastructure
- Introduce malicious code, bots, or automated scraping tools
- Resell or sublicence access to the service without our written agreement
- Use the service in a way that imposes unreasonable load on our infrastructure
We reserve the right to suspend or terminate accounts that breach these terms. We will give you written notice and a reasonable opportunity to remedy a breach before taking action, except where the breach is serious or places us at legal risk.
10. AI features and professional responsibility
10.1 Voice capture
Voice capture uses AI to extract BS 5837 field values from your recordings. The output is a draft — it may be incomplete or incorrect. You must review every field before saving a tree record.
10.2 Species identification
The species identification feature uses the Pl@ntNet API to suggest species from photos. Results are presented as "the AI suggested" with a confidence score. Species suggestions are not authoritative. You, as the qualified arborist, make the final determination.
10.3 Report drafting
AI-generated report narrative is a draft. It reflects the data you entered. You are responsible for reviewing the complete report, correcting any errors, applying your professional judgement, and signing off the document before delivering it to any client.
10.4 No warranty of professional fitness
tree·canopy is a productivity tool for qualified professionals. It is not itself a professional arboricultural service. Nothing in the service constitutes arboricultural advice. Your professional obligations (including those under BS 5837:2012, ISA standards, or any applicable regulation) remain yours.
11. Our intellectual property
The tree·canopy application, its design, code, branding, and documentation are owned by Aurenia Group Limited and protected by copyright and other intellectual property laws. These terms give you a licence to use the service; they do not transfer any ownership to you.
12. Availability and uptime
We aim to keep tree·canopy available and will communicate planned maintenance in advance. The service is provided "as is" and we do not guarantee any specific uptime level. We are not liable for losses arising from service interruptions.
The mobile application includes offline functionality — you can capture and store survey data without a network connection. Data syncs when connectivity is restored.
13. Limitation of liability
13.1 Exclusion of certain losses
To the maximum extent permitted by law, we are not liable for:
- Loss of profits, revenue, or business opportunity
- Loss of data (beyond the obligations in section 8)
- Any indirect, consequential, or special loss
13.2 Cap on liability
Our total liability to you in connection with these terms and the service in any 12-month period is capped at the greater of £500 or the total fees you paid to us in the 12 months immediately preceding the claim.
13.3 What this does not affect
Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
14. Indemnity
You agree to indemnify and hold harmless Aurenia Group Limited from any claims, losses, or damages (including legal costs) arising from: (a) your use of the service in breach of these terms; (b) survey data or reports you produce using the service; or (c) your breach of any applicable professional regulation.
15. Termination
15.1 By you
You may terminate your account at any time by cancelling your subscription and deleting your account in settings.
15.2 By us
We may suspend or terminate your account immediately if you breach these terms in a way that is serious or irreparable, or if required to do so by law. For remediable breaches, we will give you 14 days' written notice and an opportunity to cure.
15.3 Effect of termination
On termination, your access to the service ceases. Data deletion timelines are as described in section 8.3. Sections 8, 10, 11, 13, 14, and 16 survive termination.
16. General
16.1 Governing law and disputes
These terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any dispute arising from them will be subject to the exclusive jurisdiction of the courts of Nova Scotia, Canada. If you are a UK-based customer and a mandatory rule of English law would otherwise apply in your favour, nothing in this clause removes that protection.
16.2 Entire agreement
These terms, together with the Privacy policy and (where applicable) the Data Processing Agreement, form the entire agreement between you and us relating to the service. They replace any prior representations or agreements.
16.3 Changes to these terms
We may update these terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use after the effective date of a change constitutes acceptance.
16.4 Severability
If any provision of these terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remainder of the terms will continue in full force.
16.5 Waiver
Failure to enforce any provision of these terms does not constitute a waiver of our right to enforce it in future.
16.6 Assignment
You may not assign your rights under these terms without our written consent. We may assign our rights to a successor entity in connection with a merger, acquisition, or sale of substantially all our assets.
